General terms and conditions of business
The following terms and conditions form part of the charter agreement for a houseboat concluded between the customer, hereinafter referred to as the "Charterer," and Hausboot-Havelskipper GbR, owned by Kathrin Beckmann-Klee and Maximilian Klee, hereinafter referred to as the "Charterer." By booking, the Charterer accepts these terms and conditions for themselves and any accompanying persons.
1. Conclusion of contract
By submitting the online booking form, the charterer submits a binding contract offer to the charter company. The charter company may reject this offer without giving reasons. A legally binding contract is only concluded upon the charter company's sending of a booking confirmation. A copy of a valid ID card must be enclosed with the charter agreement.
2. Prices and payment due date
A deposit of 50% of the charter price is due within 5 days of receiving the booking confirmation. The remaining amount is due 4 weeks before departure. For short-term bookings, the total amount is due immediately.
- For a stationary houseboat, cleaning is included in the rental price and no deposit is charged.
- For a moving houseboat, a cleaning fee of €70 must be paid separately in cash to the external service provider "Reinigungsservice Maximilian Klee" before departure. A deposit of €500 in cash is also required.
3. Cancellation / withdrawal from the contract
The charterer may withdraw from the contract in writing before departure. Cancellation fees depend on the time of withdrawal:
- 0% more than 90 days before departure
- 50% for 89–30 days before departure
- 90% if booked 29–4 days before departure
- 100% if less than 4 days before departure
Any statutory right of withdrawal remains unaffected.
4. Unavailability
If the charter company is unable to provide the boat through no fault of its own, all payments will be refunded. No liability is assumed for force majeure or official restrictions.
5. Handover/return of the houseboat
- Houseboat in motion: Handover is at 3:00 PM, return by 10:00 AM. Damage will be documented together. Late return will be charged €50 per hour or part thereof.
- Stationary houseboat: Key handover will take place at the agreed time. Fueling and technical briefing are omitted.
6. Boat captain
The boat operator must be of legal age and is jointly liable with the charterer. If there are any doubts about suitability, the boat may be refused.
7. Use of the houseboat
- Houseboat in motion: The boat must be treated with care. All regulations must be observed. No travel in winds of force 4 or higher. Accidents must be reported immediately. No barbecuing or subletting is permitted.
- Stationary houseboats: General house rules apply. Shipping regulations, locks, and navigation do not apply.
8. Liability
- Houseboat in motion: Hull and liability insurance included. Damages are to be reimbursed by the charterer. Deposit: €500.
- Stationary houseboat: No deposit, but liability for damage caused.
9. Place of jurisdiction and place of performance
The place of jurisdiction is Brandenburg an der Havel. German law applies exclusively. Any subsidiary agreements must be made in writing.
10. Website
The website is updated regularly. Changes to the website only affect future bookings. Existing bookings are subject to the terms and conditions agreed upon at the time of booking confirmation.
11. Vouchers and discount promotions
Discounts and vouchers are only valid as stated and are non-refundable. They do not apply to deposits or final cleaning.
12. Smuggling and tracking
Locks are only permitted by prior arrangement. The boat is equipped with GPS tracking.
13. Right of withdrawal
- Stationary houseboat: No right of withdrawal (§ 312g para. 2 no. 9 BGB).
- Moving houseboat: For distance selling bookings, there is a 14-day right of withdrawal according to Section 355 of the German Civil Code (BGB).
14. Instructions
Before setting off, you will receive an introduction to navigation rules, maneuvering, and boat use. This instruction is not required for the stationary houseboat.
15. Damage / failure during the charter
- Moving houseboat: If damage is caused by the charterer, a loss of earnings can be claimed.
- Stationary houseboat: In case of deliberate damage, cleaning costs or compensation may be claimed.
16. Severability Clause
Should individual provisions be invalid, the remainder of the contract shall remain valid.
17. Cleaning regulations and legal classification
17.1 Stationary houseboat: Accommodation without cancellation rights. Cleaning is included in the price.
17.2 Houseboat on Wheels: Right of Cancellation for Distance Selling. Cleaning by the external service provider "Reinigungsservice Maximilian Klee" or another service provider. A flat rate of €70 is payable separately. In case of cancellation after departure, a flat rate of €70 may be deducted from the deposit.
